If a police officer suspects you of driving under the influence, he or she will ask you to submit to a breath or blood test to determine your blood alcohol concentration level.   It is unlawful to drive a vehicle if your BAC is .08% or higher.  If the results of the breath or blood test indicate that your BAC is .08% or more, you will be arrested on DUI charges and your driver’s license will be confiscated.  You driver’s license will also be revoked if you refuse to submit to either a breath or blood test.

10 Day Rule

If you were arrested for DUI in Atlanta, the police officer probably gave you a notice saying your license is being suspended. The 10 day rule gives you the opportunity to try and get your driver’s license back.  This rule states that you have 10 days from the date of your arrest to schedule an administrative license suspension hearing with the Georgia Department of Driver Services.  If you do not schedule this hearing within the 10 days following your arrest you will lose your right to a hearing and your driver’s license will automatically be suspended for one year.

What is a License Suspension Hearing?

A license suspension hearing is your chance to contest the accusations made by the arresting officer and prevent your driver’s license from being suspended. If you are successful at this hearing your driver’s license will be returned. If you are unsuccessful then your license will continue to be suspended.
