Georgia’s DUI Laws According to Georgia’s DUI laws, it is illegal to operate an automobile while under the influence of alcohol, drugs, or a combination of alcohol and drugs to the extent that you are a less safe driver.  It is also illegal to operate an automobile with a blood alcohol concentration (BAC) of 0.08% or higher.  If you are under the age of 21 years old, it is illegal to operate an automobile with a BAC of 0.02% or higher.

If you have been arrested for DUI in the State of Georgia, your driver’s license can be administratively suspended separate and apart from your criminal case.  You only have 10 days from the date of your DUI arrest to request an administrative hearing with the Georgia Department of Driver’s Services.  If you do not request an administrative hearing within ten days of your arrest, your driving privileges will be automatically be suspended for up to a year.
